Many construction and engineering contracts require that any dispute be referred to an Arbitrator rather than a court.

Arbitrators are appointed from accredited lists maintained by professional bodies, for example the RICS, ICE, CIA etc

An Arbitrator will often have specialist knowledge of the area of the dispute and will have wide powers to investigate the issues and dispose of the matter.

As Arbitrators are able to bring their personal expertise to a dispute they can focus on the important issues and are often able to use their own expertise to decide issues of fact.

Arbitrations are governed by the particular rules that the contract requires the parties adopt.
